SERVICE STATION OWNER FINED £1,500 FOR SEWAGE POLLUTION
Mr Maurice Magowan of Glenavy Road Service Station, Moira has been fined £1,500 plus costs following two sewage pollution incidents.
On 11 December, Craigavon Magistrates Court fined Mr Magowan £1500 plus court costs totalling £271.98. The court was told that on 23 August 2005, an officer from the Environment and Heritage Service found a discoloured and foul smelling discharge from a sewage treatment plant at the Glenavy Road Filling Station, Moira. A sample of this effluent was collected, and later analysis showed it to be highly polluting. On a return visit to the service station on 26 October 2005 it was found that the sewage treatment plant at the service station was broken. A sample of the effluent was again collected and again was found to be highly polluting.

The prosecution was taken under Article 7(1)(a) of The Water (Northern Ireland) Order 1999. This article states that a person commits an offence if, whether knowingly or otherwise, he discharges or deposits any poisonous, noxious or polluting matter so that it enters a waterway or water contained in any underground strata.
