DUNGANNON MAN FINED FOR WASTE OFFENCES

Joseph Norman Irwin of Lislasly Road, Dungannon was fined a total of £181 at Dungannon Magistrates Court yesterday for pollution.

On 11 January 2006, Environment and Heritage Service officers inspected land belonging to Mr Irwin at Derrycarne Road, Portadown, where they found controlled waste.

Mr Irwin pleaded guilty to two charges of depositing controlled waste and one charge of keeping controlled waste on his land without a waste management licence. He was fined £50 for each offence, plus court costs of £31.

Mr Irwin was fined under the following sections of the Waste and Contaminated Land (Northern Ireland) Order 1997:

Article 4(1)(a) "a person shall not deposit controlled waste, or knowingly cause or knowingly permit controlled waste to be deposited in or on any land except under and in accordance with a waste management license". In accordance with Article 4(6) "Any person who contravenes paragraph (1) or any condition of a waste management license shall be guilty of an offence."

Article 4(1)(b)(i) "a person shall not treat, keep or dispose of controlled waste, or knowingly cause or knowingly permit controlled waste to be kept, treated or disposed of in or on any land, except under and in accordance with a waste management license". In accordance with Article 4(6) "Any person who contravenes paragraph (1) or any condition of a waste management license shall be guilty of an offence."
