CHEESE COMPANY FINED FOR WASTE OFFENCES

An Illegal waste site resulted in fines totalling £2,000 being awarded at Lisburn Magistrates' Court yesterday.

On 21 July 2005, Environment and Heritage Service officers investigated complaints of a foul odour, at a site adjacent to17 Leckey Road, Maghaberry, controlled by Mr Glenn Smyth, of 21b Chapel Road, Aghalee.

Glanbia Cheese Ltd, 35 Steps Road, Magheralin, Craigavon, pleaded guilty to two charges related to the deposit of controlled waste on the land without a waste management licence and failure to produce a Waste Transfer note, and was fined £750 for each charge (plus court costs of £98).

Mr Smyth admitted to transporting 100 loads of waste to the site from Glanbia Cheese Ltd. He pleaded guilty to two charges related to the deposit of controlled waste on the land without a waste management licence and failure to produce a Waste Transfer note and was fined £250 for each charge (plus court costs of £98).

NOTES TO EDITORS:

  1. The controlled waste was whey, a by-product of the manufacture of cheese.
  2. The following charges were brought:

    • Article 4(1)(a) of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to the deposit of controlled waste, or knowingly causing or knowingly permitting controlled waste to be deposited in or on land unless a waste management licence authorising the deposit is in force and the deposit in accordance with the licence.
    • The Waste and Contaminated Land (NI) Order 1997 - Article 5(1)(a) - "Failure to take all such measures applicable in that capacity as are reasonable in the circumstances to prevent any contravention by any other person of Article 4".
