COMPANIES FINED FOR WASTE OFFENCES ON ARDS PENNINSULA
Three companies, who pleaded guilty to illegal waste offences, have been fined at Ards Magistrates' Court on 26 October 2006.
On 30 March 2004 Environment and Heritage Service officers investigated complaints of the illegal disposal of construction and demolition waste at Sandycove Caravan Park, near Millisle, Co. Down.
During the investigation, it was determined that Pearlow Developments Ltd had produced the waste material from a demolished building. The waste was then transported by C&S Pearson Ltd, at the request of the caravan park owners, to the final disposal site at Sandycove Caravan Park.
Sandycove Holiday Homes Ltd, of Whitechurch Road, Ballywalter was fined £150 for each of five charges for breaches of waste management legislation and breaches of the Environment Order and pleaded guilty to carrying out work on an Area of Special Scientific Interest (ASSI) without consent and causing damage to it.
Pearlow Developments Ltd, Ballybarnes Road, Newtownards was fined £250, and C&S Pearson Ltd Ballybarnes Road, Newtownards, £150 for each of two charges, for breaches of waste management legislation.

- Article 4(1)(a) of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to the deposit of controlled waste, or knowingly causing or knowingly permitting controlled waste to be deposited in or on land unless a waste management licence authorising the deposit is in force and the deposit in accordance with the licence.
- Article 4(1)(b) of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to the treating and keeping of controlled waste, or knowingly causing or knowingly permitting controlled waste to be kept or treated in or on land except under and in accordance with a waste management licence.
- Article 5(1)(a) of The Waste and Contaminated land (NI) Order 1997. The charge related to the failure to take all sure measures that would prevent any contravention by any other person of article 4(1) of the Waste and Contaminated Land (NI) Order 1997.
- Article 46(1) of The Environment (NI) Order 2002. The charge relates to work being carried out on an ASSI without prior consent being given by the department.
- Article 46(6) of The Environment (NI) Order 2002. The charge relates to work being carried out on an ASSI that caused damage to that ASSI.
- The charges Pearlow Developments Ltd pleaded guilty to were:
- Article 5(1)(c)(ii) of The Waste and Contaminated Land (Northern Ireland) Order 1997. The charge related to there being no waste transfer notes produced, on the transfer of the waste, which included a written description of the waste.
- The charges Pearlow Developments Ltd pleaded guilty to were:
- Article 4(1)(a) of The Waste and Contaminated Land (Northern Ireland) Order 1997.
