TYRONE LANDOWNER AND COMPANY FINED A TOTAL OF £4000
A Tyrone construction company and a landowner have been fined for waste management offences.
P K Murphy Construction Ltd, Sluggan Road, Pomeroy, was fined a total of £3000 and Patrick Trainor, of Martray Road, Ballygawley was fined a total of £1,000 at Dungannon Magistrates' Court today.
During an investigation in July and August 2005, at a site on the Sluggan Road, Pomeroy, Environment and Heritage Service officers observed controlled waste including construction and demolition waste.
The investigation concluded that P K Murphy Construction Ltd had used the site for the disposal of controlled waste. Mr Patrick Trainor, whose family owned the site, had permitted the waste to be disposed at the site.
P K Murphy Construction Ltd complied with the Department's direction to remove waste from the site.

P K Murphy Construction Ltd was charged under Articles 4(1)(a) and (b) of The Waste and Contaminated Land (Northern Ireland) Order 1997:
- One charge of knowingly permitting controlled waste to be deposited on land without a waste management licence in force.
- One charge of keeping controlled waste on land not covered by or in accordance with a waste management licence.
- Patrick Trainor was charged under Articles 4(1) (a) and (b) of The Waste and Contaminated Land (Northern Ireland) Order 1997:
- One charge of knowingly permitting controlled waste to be deposited on land without a waste management licence in force.
- One charge of keeping controlled waste on land not covered by or in accordance with a waste management licence.
- Controlled waste is household, commercial or industrial waste. It may be solid or liquid. It does not have to be toxic or hazardous
